THE FOLLOWING DESCRIBES THE TERMS UPON WHICH TASTEFULLY DRIVEN OFFERS YOU ACCESS TO OUR SERVICES. BY USING THE TASTEFULLYDRIVEN.COM WEB SITE YOU ARE AGREEING TO BE BOUND BY THESE TERMS.

We can amend this agreement at any time by posting the amended terms on the site. All amended terms will automatically be effective immediately after they are initially posted on the site unless otherwise specified. If we make material changes to this agreement, we will notify you here, by email, or by means of a notice on our home page. Conditions

Use of the Products and Services is subject to compliance with these Terms and Conditions. You acknowledge and agree that Tastefully Driven may terminate your access to the Tastefully Driven site should you fail to comply with the Terms and Conditions or any other guidelines and rules published by Tastefully Driven. Any such termination shall be in the sole discretion of Tastefully Driven and may occur without prior notice, or any notice. Tastefully Driven also reserves the right to terminate any user's access to Tastefully Driven at its sole discretion for any reason or for no reason at all, if Tastefully Driven believes the user may be directly or indirectly harmful to other users, to Tastefully Driven or its subsidiaries, affiliates, or business contractors, or to other third parties, or for any conduct that violates any local, state, federal, or foreign laws or regulations.

Shipping Policies

Tastefully Driven makes every effort to ship all orders within one business day of being placed. Occasionally there are delays beyond our control or backordered items that can cause delays. We will make every effort to contact you through email, phone, or on our website if we expect your order to take longer to ship.

FedEx ships Monday through Friday, excluding holidays and some select days for Express services. Tastefully Driven is not responsible for delays relating to FedEx’s services or any damages resulting from delayed shipments.

All APO and International order will be shipped via United States Postal Service with no exceptions. Tastefully Driven is not responsible for delays relating to United States Postal Service or any other carrier shipping service.

Estimated time of deliveries from FedEx and United States Postal Service are not guarantees and should only be used an estimate. Tastefully Driven is not responsible for any damages resulting from delayed deliveries. Tastefully Driven is also not responsible for any additional charges that result from international shipping such as duties, fees, taxes, etc.

Orders containing an aerosol product can only be shipped to US addresses via FedEx Ground. If any expedited shipping option is selected that requires air transportation the order will automatically be demoted to Ground Shipping and the proper dollar amount will be refunded when applicable. Tastefully Driven is not responsible for any damages resulting from delayed deliveries.

Orders that contain incorrect or undeliverable shipping information, as entered by the customer, which can not be delivered by any carrier, will have the customer be responsible for additional shipping charges to complete the delivery. If the customer then cancels the order there shall be no refund for any shipping charges. If there are charges for sending the item back to Tastefully Driven the additional shipping charges are the responsibility of the customer.

Return Policies

Unopened products are available for return or exchange 30 days from the date of purchase. The customer is responsible for any shipping charges back to Tastefully Driven and any ensuing shipping charges. Shipping charges from the original order will not be refunded.

Refunds will be issued in the form of a credit to your account or a check will be issued for the amount of the return. Under no circumstances will a credit card be charged back.

If you feel as though a product you have purchased through Tastefully Driven may be defective, returns should be made directly through the manufacturer. If you need help finding the contact information of a manufacturer you may contact us.

Eligibility

To use Tastefully Driven’s services, you must be at least 18 years of age and be able to form or enter into a legally binding contract in accordance with applicable laws. If you are under the age of 18, you can use this service only in conjunction with and under the direct supervision of a parent or guardian who agrees to be bound by these terms. If you are eligible to use our services, you must complete the registration process by providing Tastefully Driven with true and correct information as required on the Tastefully Driven registration form. If the information you provide is found to be false, we may suspend or terminate your registration and account.

Stability

Neither you nor any parties affiliated with, contracted by, or created by you may take any actions to interfere with or interrupt, the operation or stability of the Tastefully Driven web site. This includes, but is not limited to, the use of any software, device, or programming routine that could place excessive loads on our system or interfere with any listing on our site, or any users account or information.

Account, Password, and Security

You will receive a password and account upon completing the registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You may not disclose, share, or distribute your password to any third party. If you feel your password has been jeopardized, you may change your password at any time, and as frequently as you wish by accessing the My Account section of the site. You agree to immediately notify Tastefully Driven of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session. You also understand that the data (including your content) may be transferred unencrypted and involve transmissions over various networks. Tastefully Driven can not and will not be liable for any loss or damage from your failure to comply with these security obligations.

In the event that your information creates a liability to us that may cause our Internet Service Provider (ISP), suppliers, agents, or contractors to sever their services to us because of such liability, we may take appropriate actions regarding such information.

The use of your information is explained in our Privacy Policy that can be located at http://www.tastefullydriven.com/privacy.php and is incorporated in this agreement by reference.

Copyright and Content Ownership

All content under the domain Tastefully Driven.com is protected by the copyright laws of the United States of America. You agree not to reproduce, sell, or exploit any portion of Tastefully Driven without the express written consent of Tastefully Driven.

You retain all intellectual property rights over information and material that you provide in conjunction with the use of the Tastefully Driven service. Tastefully Driven has the right in their sole discretion to review and remove any content for any reason.

Limitation of Liability - Non Warranty

IN NO EVENT SHALL Tastefully Driven (INCLUDING OUR SUPPLIERS, OFFICERS, DIRECTORS, EMPLOYEES) BE LIABLE FOR LOST PROFITS, REVENUES, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) RESULTING FROM OR IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SITE.

THE SITE AND SERVICES ARE OFFERED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTIES OR GUARANTEES EXPRESSED OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT.

Breach

Without limiting other remedies, we may limit your activity, immediately remove your account, warn our community of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you if: (a) you breach this agreement or the documents it incorporates by reference; (b) we are unable to verify or authenticate any information you provide to us; or (c) we believe that your actions may cause financial loss or legal liability for you, our users or Tastefully Driven.

Indemnification

You agree to indemnify and hold harmless Tastefully Driven, its officers, employees, parent companies, subsidiaries, contractors, vendors or affiliates, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Tastefully Driven, the violation of this User Agreement by you, or the infringement by you or any other user of this site using your computer, of any intellectual property or other right of any person or entity.

Legal Responsibility

It is your responsibility to comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase and sale of items through our site.

Violation of User Agreement

We may terminate your account, registration temporarily or permanently should you violate any portion of this User Agreement. Tastefully Driven reserves the right to refuse service to anyone for any reason at any time. The failure of Tastefully Driven to enforce any provision of this document does not constitute a waiver of such provision.
